Fixed Period Rental Agreement
A periodic lease continues under the same conditions and you should pay your rent as usual. It will run monthly or weekly, depending on how often your rent was due during the fixed period. Short-term leases can be written or oral, but we recommend the use of written leases. Owners and tenants can use our Form 1 – Rental Agreement (Word, 1.5MB). Additional terms and conditions may be included and the agreement must comply with the Residential Tenancies Act 1997. Once you have accepted a new fixed term, it binds you and commits you. The rental conditions may not exactly match the current temporary rent. A month-to-month lease could be a very short version of a fixed-term lease that lasts only one month. But there is one key difference: monthly contracts are automatically renewed if neither you nor your landlord cancels the evacuation within a specified time frame. For example, if you want to move at the end of October, you may need to notify the landlord before the end of September. A periodic lease has no deadline. It continues until the tenant or landlord indicates in writing the termination.
Your landlord or broker can contact you during the lease to see if you intend to stay when the life is over. A temporary rent lasts only for the time set in the tenancy agreement. You don`t have to worry about breaking a lease in the middle of a one- or two-year term, which could be expensive.
Instead, you can complete one month of monthly leaseback per month by providing sufficient notice (usually 30 days) to the owner. Of course, the owner has the same flexibility. As a tenant, you live with the risk of being terminated at any time for non-renewal, at that time you would only have 30 days (or a little more if the landlord gives the message in the middle of a month) to find a new home. This is a good option if you don`t want to be tied to a new fixed date. For example, if you plan to move soon, but not yet. Your lease automatically becomes a periodic lease if you survive the end of the limited term without a renewal contract.
